Rental Contract — Renters

1. Governing Terms

1.1 Your Rental Contract

Your contract to hire a trailer through TrailerConnect (Rental Contract) consists of:

  • the booking confirmation issued by TrailerConnect;
  • our Privacy Policy; and
  • these Terms of Service.

These documents create binding and enforceable legal obligations. Completing the booking process confirms your acceptance of these obligations.

1.2 TrailerConnect’s Role

TrailerConnect Pty Ltd ABN 19 695 664 361 (“TrailerConnect”, “we”, “us”) operates an online peer-to-peer marketplace. TrailerConnect facilitates the rental agreement between the Renter and the Owner and may act as agent for administrative purposes, including payment processing, bond administration, and dispute resolution. TrailerConnect does not own, control, or manage any listed trailer.

TrailerConnect uses payment pre-authorisation to hold funds at the time of a booking request. Funds are captured only upon Owner confirmation. If the Owner declines or does not respond within 24 hours, the hold is released automatically and no charge is made.

1.3 Jurisdiction

The Rental Contract is governed by the laws of Victoria, Australia. You agree that Victorian courts have non-exclusive jurisdiction to determine any dispute between you and TrailerConnect or the Owner.

1.4 Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies rights conferred by the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)) or any other applicable Federal, State or Territory legislation.

2. Who May Tow the Trailer?

2.1 Authorised Drivers

The trailer may only be towed by you or a person you have named as an Authorised Driver at the time of booking.

It is a Major Breach of the Rental Contract to allow any unauthorised person to tow the trailer.

2.2 Age and Experience

You and any Authorised Driver must:

  • be at least 18 years of age; and
  • have held a full, unrestricted Australian driver’s licence for at least 12 months.

2.3 Licence Requirements

You and any Authorised Driver must hold a valid Australian driver’s licence appropriate for towing that is:

  • issued by an Australian state or territory; and
  • not subject to any restriction or condition that would prevent lawful towing.

Learner, provisional (P1 or P2), and probationary licence holders must not tow the trailer.

2.4 Cancelled and Suspended Licences

The trailer must not be towed while your licence is cancelled or suspended, or within 2 years of any prior cancellation or suspension.

2.5 False Information

The trailer must never be towed by any person who has provided false or misleading personal details, including name, age, address or driver’s licence information.

2.6 Tow Vehicle Responsibility

The Renter is solely responsible for their towing vehicle, including its roadworthiness, registration, insurance, and compliance with the vehicle manufacturer’s maximum towing capacity and towbar ratings. TrailerConnect accepts no liability for any loss, damage, or injury arising in connection with the Renter’s towing vehicle.

3. Prohibited Use

3.1 Prohibited Towing

You and any Authorised Driver must not tow the trailer:

  • while intoxicated or under the influence of alcohol or drugs, or with a blood alcohol or drug level exceeding the legal limit;
  • recklessly or dangerously; or
  • while the trailer is damaged or in an unroadworthy condition.

3.2 Prohibited Conduct

You and any Authorised Driver must not:

  • fail or refuse to undergo any breath, blood, urine or oral fluid test or drug impairment assessment;
  • use the trailer for any illegal purpose;
  • use the trailer to move dangerous, hazardous or inflammable goods or substances in quantities above that used for ordinary domestic purposes;
  • carry illegal drugs or substances in the trailer; or
  • use the trailer in any unsafe or unroadworthy condition.

3.3 Prohibited Actions

You and any Authorised Driver must not:

  • deliberately or recklessly damage the trailer;
  • modify the trailer in any way;
  • sub-hire, re-let, sell or dispose of the trailer; or
  • register or claim to be entitled to register any interest in the trailer under the Personal Property Securities Act 2009 (Cth).

3.4 Excess Loads

You must not use the trailer to carry any load exceeding the limits for which the trailer was designed, constructed, registered or licenced.

4. Prohibited Areas

4.1 Prohibited Roads

The trailer must not be towed on:

  • unsealed roads;
  • off-road terrain; or
  • any area where snow has fallen or is likely to fall.

4.2 Prohibited Areas

The trailer must not be used in:

  • roads prone to flooding or that are currently flooded;
  • beaches, streams, rivers, creeks or floodwaters;
  • any road subject to a police or authority warning or closure; or
  • any location where it would be unsafe to operate the trailer.

5. Your Obligations

5.1 Reasonable Care

You and any Authorised Driver must take reasonable care of the trailer by:

  • preventing it from being damaged;
  • protecting it from the weather where practicable;
  • maintaining tyre pressures;
  • ensuring it is not overloaded; and
  • when parked, ensuring the trailer is secured and cannot be removed from the towing vehicle.

5.2 Safe Operation

Before and during use you must ensure:

  • the weight of the load is at least 60% in the front half of the load space, or — if towing a vehicle — evenly distributed;
  • the Aggregate Trailer Mass does not exceed the lesser of the towing vehicle manufacturer’s maximum towing mass or the towbar rating;
  • the trailer is correctly and safely connected with safety chains properly fitted;
  • the coupling is attached at all times including during loading and unloading;
  • the jockey wheel is raised and secured before travel;
  • the coupling handle is locked down;
  • tyres are inflated to the manufacturer’s recommended PSI; and
  • trailer lights are working correctly.

5.3 Load Security

You must secure all property, goods and equipment carried in the trailer using appropriate tie-down materials so that nothing can fall from the trailer during transit. You must comply with all road rules and regulations.

5.4 Notification of Faults

You must inform the Owner and TrailerConnect immediately at hello@trailerconnect.com.au if the trailer develops any fault during the hire period.

5.5 No Unauthorised Repairs

You must not allow anyone to repair, tow or salvage the trailer without prior written authority from the Owner or TrailerConnect.

5.6 Extensions

Hire periods cannot be extended except by making a new booking, subject to the trailer being available.

6. Trailer Handover — Renter

6.1 Collection

You must attend the agreed pickup location at the agreed time. If the trailer does not meet the advertised specification, you are under no obligation to proceed with the hire.

6.2 At Collection You Must

  • produce your driver’s licence for inspection by the Owner;
  • confirm the trailer is in a roadworthy, serviceable and clean condition;
  • take high-definition photographs of the front, rear, sides and each wheel of the trailer — uploaded through the Platform where possible. If the handover is not in daylight, use flash; and
  • note any pre-existing damage in writing before departing.

If no pre-hire damage is recorded by either party, the trailer is deemed to have been handed over in good condition.

Important: If these photographs are not taken, you may forfeit the right to dispute any damage claim arising from the hire.

6.3 Return

You must return the trailer to the Owner at the agreed return location at the agreed time in the same condition as collected (fair wear and tear excepted), and clean. You must take the same photographs at return as you took at collection.

6.4 Non-return

If the trailer is not returned at the agreed time and date, the Owner may report it as stolen and it may be de-registered.

7. Financial Obligations — Renter

7.1 Rental Fees

At the time of submitting a booking request, a pre-authorisation hold will be placed on your nominated payment card for the total amount shown at checkout, which includes:

  • the Owner’s hire fee;
  • the TrailerConnect platform service fee; and
  • any applicable Connect Cover fee.

No funds are captured until the Owner confirms the booking. If the Owner declines or does not respond within 24 hours, the hold will be released automatically and no charge will be made.

7.2 Security Bond

A security bond may be collected at the time of booking. The bond is held by TrailerConnect and released within 7 days of the trailer being returned safely in its original condition, subject to any deductions for damage or outstanding amounts.

7.3 Payment Authority

You authorise TrailerConnect to charge your payment card for:

  • rental fees;
  • tolls incurred during the hire period;
  • traffic or parking fines notified to TrailerConnect;
  • damage costs pursuant to clause 10;
  • late return fees; and
  • any failed chargeback administrative fee of $75.

7.4 Late Return Fees

If the trailer is returned 30 minutes or more after the agreed return time, a late fee of up to one full day’s rental applies. A further full day’s hire fee plus a 25% late premium applies for each subsequent day or part thereof until the trailer is returned.

7.5 Unsuccessful Chargebacks

If you initiate a chargeback that is subsequently rejected by your bank, an administrative fee of $75 applies to compensate TrailerConnect for costs incurred.

7.6 Debt Recovery

All amounts owed by you to TrailerConnect or the Owner under these Terms are a debt due and payable immediately upon demand. If any amount remains unpaid after 14 days of demand, you are liable for:

  • interest on the unpaid amount at the rate of 10% per annum, calculated daily from the due date until payment in full;
  • all reasonable legal fees and costs incurred by TrailerConnect or the Owner in recovering the debt, assessed on a solicitor-client basis;
  • all collection agency fees, court filing fees, and enforcement costs; and
  • any disbursements or out-of-pocket expenses incurred in connection with recovery.

TrailerConnect may disclose your details to a debt collection agency or, where permitted by law, to a credit reporting body.

7.7 Damage Claims — Timing

Damage claims must be submitted by the Owner within 48 hours of the trailer’s return. Late claims will generally not be accepted unless supported by clear evidence and exceptional circumstances, as determined by TrailerConnect acting reasonably and based on available evidence, including photographs, documentation and submissions from both parties.

8. Cancellations — Renter

8.1 Renter Cancellations

  • More than 24 hours before hire start: Full refund of the hire fee. The platform service fee is non-refundable.
  • Within 24 hours of hire start: No refund.
  • No-show (trailer not collected within 30 minutes of the agreed pickup time): No refund.

8.2 Owner Cancellations

If an Owner cancels a confirmed, paid booking, you will receive a full refund of all amounts paid, including the platform service fee, within 5–10 business days.

8.3 Disputes and Chargebacks

Please raise all payment disputes with TrailerConnect at hello@trailerconnect.com.au before initiating a chargeback with your bank. TrailerConnect will respond to all valid disputes promptly. Initiating a chargeback without first contacting TrailerConnect may delay resolution.

9. Traffic Offences, Fines and Tolls

You and any Authorised Driver must pay all fines, penalties, traffic infringements and tolls incurred during the hire period. A processing fee of $50 per unpaid toll applies, in addition to the toll amount. You must notify TrailerConnect in writing at hello@trailerconnect.com.au as soon as you become aware of any such fine or infringement.

10. Damage and Liability

⚠ TrailerConnect is not an insurer and does not provide insurance of any kind.

No product offered through this Platform constitutes insurance under the Insurance Act 1973 (Cth) or the Insurance Contracts Act 1984 (Cth). You are strongly encouraged to confirm with your own insurer whether your existing motor vehicle or contents policy covers hired trailers and third-party towing liability before proceeding with any hire.

10.1 Renter Liability for Damage

Subject to clauses 10.2 and 10.3, you are fully and personally liable for all loss or damage to the trailer caused or arising during the hire period, whether by accident, negligence, or any other cause, including:

  • the full cost of repair where damage is repairable;
  • the trailer’s replacement cost at current market value where it is damaged beyond repair, lost, or stolen;
  • all towing, salvage, storage and recovery costs;
  • assessment fees and claims administration fees charged by TrailerConnect or the Owner; and
  • loss of hire income for the period the trailer is unserviceable as a result of damage, calculated at the listed daily rate.

10.2 Incidental Damage Waiver (IDW)

An Incidental Damage Waiver (IDW) is automatically included with every hire at no additional cost. The IDW is not insurance. Subject to the exclusions below, the IDW waives your liability for minor cosmetic damage up to:

  • $150 per incident; and
  • $250 in aggregate per hire period.

The IDW does not apply to and provides no waiver for:

  • damage caused by or arising from an Accident;
  • structural damage to the trailer chassis, draw bar, coupling, or load-bearing components;
  • damage to tyres, wheels, lights, or electrical systems;
  • theft or attempted theft of the trailer;
  • damage caused by overloading;
  • damage caused during Prohibited Use (clause 3);
  • damage caused in a Prohibited Area (clause 4);
  • any damage arising from a Major Breach (clause 12); or
  • damage caused while your Connect Cover (clause 10.3) is void.

Where a claim exceeds the IDW threshold, you remain liable for the full amount above the waiver limit, subject to any applicable Connect Cover excess cap.

10.3 Connect Cover — Damage Liability Reduction

Connect Cover is an optional paid product available at checkout. Connect Cover is not insurance and does not constitute an insurance policy. Connect Cover reduces your maximum damage liability to the excess amount for the tier you select:

TierYour maximum liabilityCover fee
Full Cover$250 per incident$15/day
Standard Cover$1,500 per incident$12/day
Lite Cover$3,000 per incident$9/day
No CoverUp to $4,500 liabilityFree

Where Connect Cover applies and is not void, you will not be charged more than the selected excess amount per incident in relation to Damage. The IDW (clause 10.2) applies below the Connect Cover excess threshold.

Connect Cover is immediately and permanently void (and full liability applies) if:

  • you commit a Major Breach (clause 12);
  • the damage occurs during Prohibited Use (clause 3) or in a Prohibited Area (clause 4);
  • you or any Authorised Driver is under the influence of alcohol or drugs at the time of the damage;
  • the trailer is used by an unauthorised driver;
  • the trailer is wilfully or recklessly damaged;
  • the trailer is sub-hired or re-let to any third party;
  • you fail to report an Accident in accordance with clause 11; or
  • you provide false or materially misleading information in connection with any claim.

Connect Cover is not insurance. TrailerConnect Pty Ltd is not an insurer. Connect Cover does not cover third-party property damage, personal injury, goods in transit, or loss of the renter’s own property. TrailerConnect expressly disclaims all liability beyond the scope described in this clause.

How IDW and Connect Cover interact: The IDW (clause 10.2) applies first to minor cosmetic damage within its threshold. Above that threshold, Connect Cover caps your liability at your selected excess amount — provided Connect Cover is not void. If Connect Cover is void, full liability applies as described in clause 10.1.

10.4 No Cover for Goods, Third-Party Loss or Personal Injury

No waiver, liability reduction, or contractual protection under these Terms applies to:

  • loss of or damage to goods, property, or equipment transported in the trailer;
  • personal items left in or stolen from the trailer;
  • third-party property damage arising from your use of the trailer;
  • personal injury or death of any person; or
  • any consequential, indirect or economic loss of any kind.

You fully indemnify and hold harmless TrailerConnect and the Owner against any claim, liability, loss, damage, cost or expense (including legal fees on a solicitor-client basis) arising from or in connection with any of the above.

10.5 Hire Fees During Repair

If damage to the trailer renders it unserviceable, you remain liable for loss of hire income at the daily listed rate for up to 14 days, unless otherwise agreed in writing between you and the Owner. This liability is not capped by Connect Cover.

10.6 TrailerConnect’s Absolute Limitation of Liability

To the maximum extent permitted by law:

  • TrailerConnect is not liable for any indirect, consequential, special, punitive, or incidental loss or damage of any kind, including lost profits, loss of data, or loss of goodwill;
  • TrailerConnect is not liable for any loss or damage arising from the acts or omissions of Owners or Renters, the condition of any trailer, or the outcome of any hire;
  • TrailerConnect is not liable for any personal injury or death arising from or in connection with the use of any trailer listed on the Platform;
  • TrailerConnect is not liable for any third-party property damage caused by a trailer listed on the Platform;
  • TrailerConnect’s total aggregate liability for any claim, in any form and on any basis, is strictly limited to the platform service fee actually paid by you to TrailerConnect in the 12 months immediately preceding the event giving rise to the claim; and
  • if that fee is zero, TrailerConnect’s liability is zero.

Nothing in this clause limits any right you may have under the Australian Consumer Law that cannot be excluded by agreement.

11. Accident Reporting

11.1 Reporting Obligations

If you have an accident or the trailer is stolen, you must:

  • report to TrailerConnect within 12 hours at hello@trailerconnect.com.au with a full description;
  • report to police if any person is injured, if the other party leaves the scene without exchanging details, or if the other party appears to be intoxicated;
  • exchange names, addresses and telephone numbers with all parties involved;
  • record the registration numbers of all vehicles; and
  • photograph all vehicles, property, the general area and any road or traffic signs.

11.2 Ongoing Cooperation

You must forward all third-party correspondence or court documents to TrailerConnect within 7 days of receipt, and cooperate fully with any investigation or legal proceedings.

11.3 What You Must Not Do

You must not admit fault, promise to pay, settle any third-party claim, or waive any liability on behalf of TrailerConnect or the Owner without our prior written consent.

12. Major Breach and Termination

12.1 Major Breach

A Major Breach of the Rental Contract occurs where a breach of clauses 2, 3, 4, 5.1, 5.2, 5.3, 5.4, or 11 causes damage to the trailer, theft of the trailer, or third-party loss.

12.2 Termination

TrailerConnect or the Owner may terminate the hire immediately upon a Major Breach and repossess the trailer. Termination does not extinguish your liability to pay outstanding fees or damages.

12.3 Repossession

The Owner may repossess the trailer without notice if you:

  • illegally park the trailer for more than 24 hours;
  • commit a reckless breach of road or traffic legislation;
  • apparently abandon the trailer;
  • fail to make payments within 24 hours of the due date; or
  • fail to return the trailer at the agreed time and date.

You grant TrailerConnect and the Owner permission, where permitted by law, to access your premises to repossess the trailer without using unreasonable force. You are liable for all towing, recovery and repossession costs.

Part B
Owner Contract

13. Governing Terms — Owners

By listing a trailer on TrailerConnect you enter into this Owner Contract with TrailerConnect Pty Ltd ABN 19 695 664 361. The Owner Contract consists of these Terms, the Privacy Policy, and your listing. The Owner Contract creates binding and enforceable legal obligations.

TrailerConnect acts as your agent with respect to the collection and disbursement of payments only. TrailerConnect is not liable to any person for costs or charges incurred in performing its obligations under the Owner Contract or to Renters.

14. Owner Obligations

14.1 Warranties

By listing a trailer you warrant that:

  • you own the trailer or hold the legal right to offer it for hire;
  • the trailer is free from security interests registered under the Personal Property Securities Act 2009 (Cth), except as disclosed to TrailerConnect;
  • the trailer is roadworthy, registered and fit for the purpose listed;
  • the listing description and photographs are true, accurate and include any known defects; and
  • the trailer will be available at the times specified in the listing.

14.2 Maintenance

Throughout the term of the Owner Contract you must maintain and pay for:

  • the trailer’s registration;
  • its roadworthiness; and
  • regular servicing in accordance with the manufacturer’s recommendations and at least once every 12 months.

14.3 Owner Insurance

The Owner warrants that they hold, and will maintain for the duration of each hire, appropriate insurance for the trailer including third-party property damage cover. The Owner accepts sole responsibility for any loss or claim arising from an absence or insufficiency of such cover. TrailerConnect is not liable for any loss arising from an Owner’s failure to maintain adequate insurance.

14.4 Booking Requests

You must accept or decline Renter booking requests promptly. Repeated or unjustified cancellations may result in listing suspension or account termination.

14.5 Handover

You must meet the Renter at the agreed pickup location at the agreed time, inspect their driver’s licence, confirm the trailer is in roadworthy and clean condition, and take the photographs required under clause 6.2.

14.6 Change of Details

You must notify TrailerConnect with at least 7 days prior written notice of any change in ownership of the trailer or your contact details.

15. Listing Rules

15.1 Listing Requirements

All listings must:

  • include honest, accurate descriptions and high-definition photographs showing all aspects of the trailer;
  • specify the trailer’s make, model and any special conditions;
  • include correct hire fees; and
  • comply with all applicable laws and regulations.

15.2 TrailerConnect Rights

TrailerConnect may remove, edit or decline listings where reasonably necessary to maintain compliance, safety, platform integrity, or compliance with these Terms or applicable law, including listings that are inaccurate or non-compliant. TrailerConnect may require a minimum listing availability of 3 months per calendar year.

16. Owner Financial Terms

16.1 Platform Fee

TrailerConnect charges a platform service fee of 10% (inclusive of GST) on each completed booking. Your payout is the hire fee less the applicable platform fee.

16.2 Payouts

Payouts are disbursed to your nominated Australian bank account via Stripe typically within 2–5 business days of booking completion, subject to your Stripe Connect account being active and verified.

16.3 Security Bond

The security bond collected from the Renter is held by TrailerConnect. A valid damage claim must be submitted within 48 hours of the trailer’s return and must include:

  • before and after photographs clearly showing the damage;
  • a written description of the damage and how it occurred;
  • a repair quote, estimate, or invoice from a qualified repairer; and
  • any other supporting documentation reasonably requested by TrailerConnect.

Where a valid claim is submitted, TrailerConnect will assess it acting reasonably based on the evidence provided and apply bond funds accordingly. If no pre-hire damage is recorded, the trailer is deemed to have been handed over in good condition.

16.4 GST

If you are registered for GST, you are responsible for your own GST obligations on hire income. TrailerConnect will issue tax invoices to Renters on your behalf as your agent.

17. Owner Cancellations

If you cancel a confirmed, paid booking, the Renter will receive a full refund including all fees. Repeated Owner cancellations may result in suspension of your listings and account.

18. TrailerConnect’s Obligations to Owners

TrailerConnect will:

  • promote the Platform and your listings;
  • enter into Rental Agreements with Renters as your agent for payment purposes;
  • collect and hold hire fees and security bonds; and
  • disburse your payout after deducting the platform fee.

TrailerConnect is not liable to you for the Renter’s conduct, damage to the trailer, personal injury, or any other loss arising from a hire. TrailerConnect does not warrant that any hire will proceed, that any Renter will comply with their obligations, or that any damage claim will result in recovery. TrailerConnect’s determination of any damage claim is made acting reasonably and based on available evidence, including photographs, documentation and submissions from both parties.

18A. Owner Indemnity

You fully indemnify and hold harmless TrailerConnect and its officers, employees, contractors, and agents from and against any claim, liability, loss, damage, cost or expense (including legal fees on a solicitor-client basis) arising from or in connection with:

  • any trailer you list on the Platform being unroadworthy, unregistered, defective, or unsafe;
  • any inaccuracy, misrepresentation, or omission in your listing;
  • personal injury or death caused by or arising from your trailer;
  • third-party property damage caused by your trailer;
  • any breach by you of these Terms or any applicable law; or
  • any act or omission by you in connection with a hire.

Some trailers listed on the Platform may be fitted with tracking or monitoring technology by their owners. By hiring a trailer, you consent to the collection and use of location and usage data for the purposes of security, recovery, compliance, and incident investigation, to the extent permitted by law. Owners who use tracking technology on their trailers must disclose this in their listing. TrailerConnect’s collection and use of any location data is described in our Privacy Policy.

20. Privacy

Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform you consent to our collection, use and disclosure of your personal information as described in the Privacy Policy.

21. Intellectual Property

You warrant you have the right to grant this licence. You may not reproduce, distribute or commercially exploit TrailerConnect content without prior written consent.

22. Personal Property Securities Act 2009 (PPSA)
